An advertising and AI lawyer with deep trademark experience, Libby O’Neill guides telecom, real estate, consumer packaged goods, food and beverage, and hospitality brands through the strategy, oversight and risk management of modern marketing, aligning creative ambition with compliant execution.
Libby counsels on national ad campaign strategy, promotions and claim substantiation. She negotiates and drafts influencer agreements across the creator economy. She defends and brings advertising challenges before the BBB National Programs’ National Advertising Division (NAD) and National Advertising Review Board (NARB) and litigates Lanham Act false advertising and related trademark matters. Her regulatory counseling spans FTC consumer protection and endorsement guides, “dark patterns,” subscription and recurring billing, and click‑to‑cancel requirements.
As part of her AI advisory and counseling practice, Libby develops practical AI governance frameworks and drafts generative AI policies and disclosures. She also addresses AI training data and IP issues, helping teams embed compliance into products and campaign workflows.
In addition to her advertising work, Libby maintains a robust trademark practice, managing global trademark portfolios for multinational companies. She leads trademark clearance, registration and prosecution matters, handles oppositions and cancellations before the Trademark Trial and Appeal Board, directs enforcement and anti‑counterfeiting programs, and negotiates licensing and brand transactions, including portfolio strategy in M&A and divestitures. Her integrated practice provides clients with a single point of counsel for the legal issues that arise across brand development, advertising and marketing, protection and growth, helping them safeguard and enhance brand equity at every stage.
