Elisabeth (Bess) Morgan is an intellectual property attorney focused on helping clients acquire, protect, enforce and exploit their trademarks and other valuable brand assets.
Bess has extensive experience managing and maintaining large domestic and international trademark portfolios, and counsels clients on brand selection, clearance, and U.S. and global filing strategy. Bess practices extensively before the U.S. Patent and Trademark Office, including prosecuting and defending opposition and cancellation actions before the Trademark Trial and Appeal Board. Bess assists clients in enforcing against unauthorized uses of their intellectual property rights, including taking down infringing domains of fraudulent websites through Uniform Domain Name Dispute Resolution Policy proceedings.
Bess’s practice also focuses on matters involving the convergence of intellectual property and advertising. She works with advertising agencies to clear intellectual property assets for use in U.S. and global campaigns. She is well versed in sponsorship and influencer agreements and guidelines, and counsels clients regarding compliance with Federal Trade Commission endorsement guidelines. Bess also has experience counseling clients on brand promotions such as contests, raffles and sweepstakes.
Bess devotes a significant portion of her practice to negotiating and drafting a variety of intellectual property-related agreements, including license, co-existence and settlement agreements. She also provides intellectual property due diligence, support, and guidance in connection with corporate transactions.
Bess has extensive experience working with clients in the media, entertainment, advertising and alcoholic beverages industries. She also represents clients in the technology, hospitality, apparel, agricultural, health, and food and beverage sectors.
In addition to her practice, Bess serves as co-chair of Loeb & Loeb’s Women’s Affinity Group in Tennessee. She lives outside Nashville with her husband, daughters, and rescue Westiepoo, Einstein. She enjoys cooking, traveling and cheering on the Fighting Irish.
