Overview

Alex Konstantynovski focuses his practice on bankruptcy, insolvency and restructuring matters, as well as bankruptcy litigation. He represents debtors, secured and unsecured creditors, ad hoc creditor groups, agents, official committees of unsecured creditors and other parties in Chapter 11 and other insolvency proceedings. Alex also advises clients in out-of-court restructurings, commercial insolvencies, liquidations and assignments for the benefit of creditors. His experience spans a broad range of industries and includes matters involving complex capital structures, recapitalization transactions and bankruptcy-related disputes.

Select examples of Alex’s prior firm experience include:

  • Represented a public telecommunications company in connection with its internal reorganization and a $500 million private equity capital raise.
  • Represented a century-old engineering and construction company in its Chapter 11 reorganization of over $1 billion of total indebtedness, which provided for payment in full to all general unsecured creditors, and related construction disputes and appeals.
  • Represented an agent and lender under a renewable energy project warehouse facility in connection with a workout of approximately $1 billion of warehouse loans, including a settlement program with hundreds of solar panel dealers and negotiations with seven tax equity partnerships.
  • Represented a leading North American manufacturer of premium glass packaging products in a comprehensive out-of-court recapitalization of $900 million in total indebtedness.
  • Represented an ad hoc cross-holder group holding over $2.3 billion in senior unsecured bonds and preferred equity in the Chapter 11 case of a failed bank’s holding company.
  • Represented an official committee of unsecured creditors in Chapter 11 cases of a leading medical genetics company and related district and circuit court appeals.
