State Age-Appropriate Website Design Laws Pick Up Steam

Loeb Advanced Media & Technology partner Nerissa Coyle McGinn is quoted in a recent Corporate Counsel article discussing the expanding wave of state age‑appropriate design laws and the growing uncertainty these laws create for companies operating online services.

In the article, Nerissa noted that the proliferation of state requirements—paired with ongoing legal challenges—makes it increasingly difficult for businesses to determine whether they are subject to these new standards.

“All of these companies need … to figure out whether or not they’re covered by these age‑appropriate design codes,” Nerissa said. “I think there are some people who are going to be shocked that they fall under them.”

She also highlighted the significant operational demands these laws impose, explaining that compliance often requires building entirely new features and tools—not simply updating privacy policies or turning off targeted advertising. The uncertainty, she added, is likely to continue unless the constitutional challenges reach the Supreme Court or Congress enacts a federal law that could preempt state rules.
