Companies Juggle Verifying Kids’ Ages With Privacy Restrictions

Jessica Lee, Loeb’s chief privacy & security partner and chair of the firm’s Privacy, Security & Data Innovations practice, is featured in a Bloomberg Law article on the growing challenges companies face in complying with state age verification laws while navigating children’s privacy requirements.

In the article, which examines how more than 25 states have adopted age verification mandates for online platforms, Jessica highlights the increasing difficulty for companies attempting to avoid acknowledging child users while remaining compliant with evolving regulations.

“The way things are moving, it’s becoming harder and harder to bury your head in the sand about whether or not there are kids on your platform,” Jessica said.

She also points to the need for greater regulatory consistency, noting, “Right now you see companies taking a variety of approaches but it would be great if there was a consistent, uniform way to approach this.”
