Loeb & Loeb LLP is proud to announce that a trial team led by Michelle La Mar, Bernard R Given II and Terry Garnett secured a victory for global IT company, Tata Consultancy Services Ltd. in a closely watched class action employment discrimination case.
A nine-member California jury issued a unanimous ruling in favor of the India-based company and found that Tata did not have a "pattern or practice" of intentionally discriminating against non-South Asian workers due to their race or national origin.
Loeb & Loeb argued that the company had actually increased its non-Indian local workforce by 400% during the class period between 2011 and 2017, invested millions in its training programs in the U.S. to recruit local workers and had no believable motive to prefer any race because 4,000-5,000 positions remained opened with no candidates to fill them.
“There wasn’t any preference for foreign workers,” La Mar said. “It is a model of growth, and growth in the U.S., and we know that there’s a STEM shortage here and that’s not a secret.”
