The harmony of the Horowitz family has evaporated. Harry, a successful businessman, has died, and his three children, David, Barry and Ellen, and his second wife of fifteen years, Wanda, are at each others’ throats. Harry’s goals of taking care of Wanda, passing his two corporations to David and Barry separately, and transferring substantially all of the balance of his assets to Ellen, is not exactly working out. The three co-executors, Barry, David, and Wanda, can barely agree on anything. Both David and Barry are accused of usurping corporate opportunities and self-dealing. There are significant tax, corporate, property, and construction issues which polarize everybody. The estate tax returns are due shortly.
Will Gary B. Freidman and Jerome L. Levine advise Wanda to exercise her right of election? Will Donald Novick and Stephen F. Melore, representing Barry, be successful in their claim that David has usurped a business opportunity? Will Ellen, represented by Ann B. Lesk and Joseph T. La Ferlita, be successful in her multiple accounting proceedings alleging breach of fiduciary duty, self-dealing, and seeking a constructive trust on Harry’s valuable art collection? Will David, represented by John R. Morken and Professor Mitchell M. Gans, be able to survive attacks from everyone? Finally, will the attorneys, with the assistance of Surrogate Czygier, be able to help their clients settle their differences?
