NLRB Again Postpones Start Date for Mandatory Posting Requirements

The National Labor Relations Board has again postponed the effective start date for its new mandatory posting requirements. As we mentioned in our September 2011 and October 2011 advisories, the NLRB announced in August that private sector employers must post a notice of employee rights under the National Labor Relations Act if the NLRA applies to the employer. After postponing the posting date from November 14, 2011, to January 31, 2012, the NLRB has again postponed the effective date until April 30, 2012. The Board’s ruling states that ”it has determined that postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule.”
