Secured Dismissal for Viacom of Trademark Case Concerning Use of “Flying V” Guitar Shape

Represented Viacom International Inc. in a case in the Central District of California in which the plaintiff, Gibson Guitar, claimed that Viacom contributed to the trademark infringement of Gibson’s trademark in a “flying V” guitar body shape. The court originally granted Viacom’s motion to dismiss for failure to state a claim, with right to replead. After an amended complaint was filed, on a second motion to dismiss by Viacom, the court dismissed the amended complaint against Viacom with prejudice.
