Represented NY City REIT against commercial tenants and guarantors for failure to pay during COVID-19

Represented a landlord in approximately 10 actions against commercial tenants and guarantors for failure to pay rent for several months during COVID-19.

In most instances despite operating during the pandemic or despite agreements to continue paying rent, and despite clauses in the leases providing that force majeure could not be a valid basis for failure to pay rent. Most of these actions were filed as motions for summary judgment in lieu of complaint. We won summary judgment in two of the actions; the remainder of the actions settled, with the last one settling in September 2022.
