Loeb & Loeb Litigation partner Joshua Hollander received a shout‑out in the Am Law Litigation Daily’s “Litigator of the Week: Runners‑Up and Shout‑Outs” column for representing Georgetown 57 LLC, the retail space tenant at Carnegie House and a co-appellant in appellate proceedings that resulted in an arbitration award increasing the cooperative's annual ground lease by more than $20 million being set aside.
In a decision issued by New York's Appellate Division, the court held that the arbitration's neutral umpire created an "appearance of impropriety" by communicating directly with the landlord's counsel regarding a paid offer to serve as an umpire in another matter and accepting that offer without informing the tenant's counsel. The court subsequently vacated the arbitration award.
