Does the New Federal Data Privacy Bill Have a Snowball’s Chance of Passing?

Jessica Lee, Loeb’s chief privacy & security partner and chair of the firm’s Privacy, Security & Data Innovations practice, is quoted in an AdExchanger article analyzing the prospects of the SECURE Data Act, a newly introduced federal privacy bill aimed at establishing a single national data privacy standard.

In the article, Jessica shared a measured assessment of the proposal, noting that while she is typically cautious about the likelihood of federal privacy legislation advancing, the bill may have comparatively stronger momentum than prior efforts. She explained that the framework largely aligns with existing state consensus models and includes several elements that are likely to resonate with businesses.

Jessica also highlighted areas that may draw scrutiny as the bill moves forward, observing that “some businesses will be concerned with the applicability thresholds, the requirements to get parental consent for teen data and the opt‑in consent required for sensitive information.”
