Hundreds of Nonprofits Made Illegal Campaign Contributions in New York

Jason Lilien, co-chair of Loeb’s Nonprofits & Tax-Exempt Organizations department, is quoted in a Times Union article discussing widespread unlawful political activity by New York nonprofits and the persistent lack of enforcement surrounding these violations.

In the article, Jason explained that many charitable organizations continue to engage in improper electioneering largely due to limited oversight and a lack of understanding of the law.

“There is a general lack of awareness in the nonprofit sector, particularly among charities, about the ban on political activity,” Jason said. “When we examined this issue years ago, the vast majority of cases was due to lack of knowledge or inadvertent failure to comply.”

He also noted that enforcement challenges have been compounded by resource constraints and unclear federal guidance, which can limit the ability of state regulators to take stronger action.
