Obtained Dismissal for Fox Entertainment Group and others in Copyright Case Concerning Television Series “Touch”

Represented Fox Entertainment Group, Inc., Peter Chernin, Kiefer Sutherland, Richard Timothy Kring and others in obtaining dismissal of a copyright infringement action alleging that the television series Touch infringed plaintiff’s screenplay and an earlier novel by plaintiff that plaintiff claimed was related to the screenplay. The court agreed that there was no substantial similarity of protectable material and noted that Fox’s series was entirely distinct from plaintiff’s storyline in both overall concept and feel. The dismissal was affirmed by the Second Circuit Court of Appeals.
