Loeb & Loeb Litigation partner Tal Dickstein is quoted in a Billboard article exploring how artists are increasingly turning to legal action to combat leaks of unreleased music and other stolen creative content.
In the article, Tal explained why leaks can be especially damaging for musicians, disrupting both the creative process and carefully planned release strategies.
“No one likes having their personal information or work product hacked and leaked to the public, and that’s especially true for recording artists and songwriters,” Tal said. “[Artists] invest enormous amounts of time, money and creative energy curating their public images and planning exactly how and when their works reach the public.”
Tal also discussed the realities of pursuing legal recourse after unreleased material has been leaked, noting that the impact of a leak is often difficult to undo once content spreads online.
“There’s usually no way to put the genie back in the bottle,” Tal said.
While identifying those responsible and recovering damages can be challenging, Tal noted that legal action can still play an important role in discouraging future misconduct and protecting artists’ creative works.
