The Cookie Conundrum: Navigating the Latest Trends in Privacy Litigation and FTC Enforcement
Loeb’s Data Governance Litigation and Investigations team delved into the latest trends in Federal Trade Commission (FTC) enforcement actions and privacy litigation in this webinar, which focused on the recent surge in lawsuits related to the use of cookies and other trackers on websites. Companies are at risk of costly settlements, fees and regulatory penalties, from claims of wiretapping violations to Video Privacy Protection Act (VPPA) actions, as the FTC continues to expand its use of all its enforcement tools.
The team shared practical advice for reducing or mitigating enforcement risks for companies and elaborated on the efforts underway to use wiretapping laws by the VPPA, other state and federal laws intended to attack the use of website cookies and trackers, and how to defend a company’s position when it is served with a civil investigative demand subpoena.

Creating an AI Use Policy for Your Company and the Legal Ethics of Using AI
Lawyers from our Advanced Media & Technology department and our Privacy, Security & Data Innovations practice, along with the firm’s general counsel and chief information officer, led a discussion on how to create an acceptable use policy for lawyers, employees and vendors regarding the use of various forms of AI. They covered key considerations in developing employee policies and distinguishing between policies for employees and vendors, and they highlighted recent cases on lawyers’ use of AI and ethical considerations for lawyers using AI.
