“Alright, Alright, Alright:” Will Hollywood’s A-List Follow McConaughey’s TM Lead?

Loeb & Loeb Litigation partner Frank D’Angelo is quoted in a World IP Review article discussing Matthew McConaughey’s use of trademark law to address unauthorized artificial intelligence (AI)-generated uses of celebrity voice and likeness.

In the article, Frank cautioned that trademark law has clear limits when applied to AI-generated content. 

“Because the Lanham Act primarily targets commercial uses that create consumer confusion, it likely does not prohibit noncommercial uses of image and likeness and therefore likely would not offer protection against the majority of deepfakes, memes and other noncommercial AI content circulating online,” he said.

Frank added that these constraints may limit how broadly the strategy is adopted, noting, “For these reasons, we may not see widespread adoption of this strategy by others.”
