Loeb & Loeb Represents Zimmer Biomet in $172 Million Lawsuit Against Deloitte

Loeb & Loeb is representing Zimmer Biomet Holdings, Inc., a publicly traded global medical devices company, in a $172 million lawsuit filed in New York Supreme Court against Deloitte Consulting LLP arising from Deloitte’s botched implementation of a new SAP S/4HANA software system for Zimmer Biomet.

According to the complaint, Deloitte landed the lucrative project by falsely assuring Zimmer Biomet it had the skills, experience, implementation methodology, tools and accelerators necessary to successfully deliver the new SAP system within the agreed-to timeframe and budget, with minimal customization. As alleged, however, the team Deloitte assigned to the Project included unskilled and inexperienced personnel who failed to apply an appropriate methodology or deploy any effective tools and accelerators and delivered an overly customized software system riddled with defects and functionality gaps for which Zimmer Biomet paid $94 million in fees. According to the complaint, after the failed “go live,” Zimmer Biomet suffered tens of millions of dollars in damages related to remediating the flawed system and business disruption to Zimmer Biomet’s operations and supply chain.

Zimmer Biomet’s claims against Deloitte include fraud, breach of contract, negligent misrepresentation and violation of New York’s deceptive trade practices act. Zimmer Biomet seeks at least $172 million from Deloitte in the lawsuit. Loeb filed the complaint on behalf of Zimmer Biomet on September 4, 2025.
