Loeb & Loeb is representing ACH Food Companies, Inc. (“ACH”), a leading manufacturer and distributor of household cooking and baking products, in a multi-million lawsuit against LeanSwift Solutions, Inc. (“LeanSwift”), now known as Wipro NextGen Enterprise, Inc., arising from LeanSwift’s botched implementation of a new Infor software system for ACH.
As alleged in the complaint, LeanSwift landed the lucrative project by assuring ACH it had the skills and experience needed to successfully deliver the new Infor system within the agreed-to timeframe and budget, but then assigned unqualified and inexperienced personnel whose design, configuration, testing, and project management failures inflicted millions of dollars in damages on ACH.
ACH’s claims against LeanSwift include fraud, breach of contract, negligent misrepresentation, and violation of Illinois’ Consumer Fraud and Deceptive Business Practices Act. In the lawsuit, ACH seeks to recover the millions of dollars in fees it paid to LeanSwift for its deficient work, as well as additional costs incurred to re-do LeanSwift’s work and transition the project to a new implementation firm. Loeb filed the complaint on behalf of ACH in Illinois Circuit Court on July 11, 2025.
The Loeb team representing ACH is led by Mark P. Ressler, chair of the firm’s Software Litigation practice, Litigation partner Joshua E. Hollander, and Litigation associates Evan Seeder and Jacob M. Sievers.
