In the article, Frank observes that a recent decision by the U.S. District Court for the Northern District of California striking down authors’ claims against an AI developer on fair use grounds may provide a “road map as to how future plaintiffs or potential plaintiffs in other existing cases can approach the fair use question in a way where they might be able to assemble a more favorable record."
