New COPPA Rule Compliance Considerations

Loeb & Loeb Advanced Media & Technology partner Nerissa Coyle McGinn is quoted in Lexology discussing the FTC’s recent updates to the Children’s Online Privacy Protection Act (COPPA) Rule and the broader implications for companies operating online services.

In the article, Nerissa highlights how the revised rule expands the criteria for determining whether a website is “directed toward children,” potentially bringing more companies under COPPA’s scope. She notes the importance of new definitions like “mixed audience sites” and emphasizes the need for businesses to reassess their age-verification systems and compliance protocols in light of these changes.

“The FTC will now be sweeping many online services into the definition of ‘directed towards children.’” She adds, “Even if an online service believes its users are over 13, it still may be considered directed to children under the new standards.”
