Hana Is No Landmark, But Might Still Affect TM Confusion

Loeb & Loeb partner Douglas Masters is quoted on the impact of the U.S. Supreme Court’s trademark ruling in Hana Financial Inc. v. Hana Bank.

Masters said “the unanimous ruling is a strong endorsement that issues involving consumer perception — tacking, likelihood of confusion, secondary meaning — are well-suited to the fact-finding role of a jury.”
