Obtained reversal of a trial court decision confirming arbitration award against a non-signatory to an arbitration agreement on the grounds that the non-signatory was the alter ego of the signatory corporation and the rules of the arbitral forum vested arbitrability decisions with the arbitrator; clarified that under California law the question of whether a non-signatory is bound by an arbitration agreement is always a question for the courts, even in instances in which the arbitration agreement or the rules of the tribunal delegate arbitrability questions to the arbitrator.
