Litigation Surrounding Historical Dam

Represent Enel Green Power North America, Inc. in connection with an appeal to the 1st Circuit Court of Appeals concerning the Pawtucket Dam located within a national park in Lowell, Massachusetts. The Federal Energy Regulatory Commission (FERC) ordered that certain modifications be made to improve and modernize the dam. The U.S. Department of the Interior objected and alleged that FERC violated federal laws in approving modernization of the dam, including The National Historic Preservation Act and the Lowell National Historical Park (Lowell Act).
