Loeb Employment & Labor partner Ian Carleton Schaefer spoke to Business Insurance about the Great Resignation and how the economic trend – along with the COVID-19 pandemic – will likely contribute to an increase in employment class action litigation in 2022, especially for wage and hour issues.
Lawyers interviewed by the publication noted that both current and former employees are more willing to be involved in class action lawsuits compared to previous years. According to Ian, “there has been a shift in the balance of power between workers and their companies.”
“When someone sees something out of order or out of compliance [they have no fear] of acting individually or collectively because they know there are plenty of jobs out there,” he said. “It’s a lower-risk proposition.”
