Entertainment Labor

Overview

#MeToo. #TimesUp. Globalization. New technologies. It’s a whole new world in entertainment, as the industry continues to expand, evolve and diversify. Union and nonunion labor and employment issues have become increasingly complex as stakeholders on all sides tackle tough, industry-altering concerns.

Loeb lawyers have decades of experience handling a myriad of labor issues unique to the entertainment, media and advertising industries. We serve as outside labor counsel for film, television, digital, new media, virtual reality, game, sports and eSports companies, as well as for advertising agencies, brands and advertisers. Our team includes lawyers who have worked in-house at major studios and guilds, giving us greater insight and perspective as to what our clients face on the labor front daily.

In addition to our work advising clients on harassment, discrimination, and bullying prevention policies and trainings, our team handles a full range of #MeToo-related labor issues, including high-profile sexual harassment and assault investigations. We not only investigate claims when they occur, but we also help our clients proactively prevent them. We provide cultural assessments and work with clients to transform their cultures so that they are more diverse, inclusive, respectful and safe.

Our team advises on and handles:

  • Advise on producing non-union and union and corporate structures related to guild and union considerations
  • Guild and union signatory processes and financial assurances
  • Collective bargaining negotiations, grievances and arbitrations with guilds and unions (including all of the U.S.-based and guilds and unions)
  • Guild and union pension and health plan audits and claims
  • Union organizing, pickets, work stoppages and strikes
  • National Labor Relations Board union election proceedings
  • Unfair labor practice charges
  • Wage-and-hour issues (many of which are unique to the entertainment industry)
  • Administrative claims and litigation, including class actions
  • Compliance with laws governing the employment of minors in the entertainment industry, including handling court approval of minors’ contracts

The Hollywood Reporter and Variety have repeatedly recognized our pre-eminence in this area.
