Mark J. Goldberg is a versatile employment lawyer who maintains an integrated litigation, transactional and counseling practice addressing the full spectrum of employment-related matters. Mark’s clients include startups, national and international companies, public entities, tax-exempt organizations, family offices and senior executives across diverse industries, including financial services, advertising, entertainment and media, technology, art, retail and manufacturing.

Mark represents clients in proceedings before administrative, arbitral, local, state and federal courts in substantive areas including employment discrimination, unlawful harassment, retaliation, wrongful termination, accommodation of disabilities and religious beliefs, restrictive covenant enforcement and defense, the duty of loyalty, unfair competition, trade secret misappropriation, breach of contract, defamation, wage and hour, whistleblowing, intentional infliction of emotional distress, fraud and statutory leave laws.

On behalf of employers and senior executives, Mark negotiates and drafts employment, termination, confidentiality, noncompetition, arbitration, consulting and other employment-related agreements. Mark also drafts employee handbooks and workplace policies.

Mark counsels clients on a wide range of complex workplace matters, including employee mobility and restrictive covenants; executive retention and departures; hiring procedures; terminations; employee complaints and accommodation requests; employment policies; workforce restructuring; background check compliance; compliance with statutory leave laws; electronic platform policies; workplace privacy; and wage and hour issues. Mark’s overriding goal is to help clients effectively manage their workforce, mitigate risk and maintain their focus on successfully operating their business.

Mark is particularly experienced in counseling clients and speaking on the evolving legal landscape governing restrictive covenants, including state-by-state enforceability, choice of law strategies and protecting confidential information and client relationships where noncompete agreements are restricted or unenforceable.

In addition, Mark conducts workplace investigations and provides management and employee training sessions on workplace sensitivity, performance management and employment policies.
