Fine Arts

Overview

Art can be a cherished family heirloom, an investment for the ages or a vehicle for philanthropy. The true value of fine art is immeasurable, and the protection and enhancement of that value are paramount.

Loeb & Loeb’s Fine Arts practice advises clients throughout the international fine arts community in the acquisition, ownership, financing and disposition of works of art. Drawn from practices across the firm, including Trusts and Estates, Tax, Finance, Intellectual Property and Litigation, our team brings a holistic view of the fine arts market to our counseling, transactional and litigation work. We advance and protect the interests of artists, owners and collectors and their estates and trusts, museums and other public and private nonprofit arts organizations and foundations, and financial institutions active in the art lending arena.

Our Fine Arts attorneys help clients:

  • Structure and administer estate, gift and income tax plans involving high-value art assets, including negotiating major donations and loans of art to museums and other charitable institutions.
  • Establish and maintain public and private arts-related charitable organizations and foundations, advising on issues related to fundraising and grantmaking, governance, regulatory compliance, tax planning and controversy, executive compensation, and corporate transactions.
  • Structure and negotiate fine-art financing transactions secured by fine art for the collector, lender or gallery, counseling on loan structures and market financing conditions, appraisals, insurance coverage, bankruptcies, and complex loan workout agreements.
  • Litigate and resolve art-related disputes, including possible infringement of copyrighted works and rights of publicity, and issues concerning ownership, valuations and authenticity.
