Obtained Victory for Dell and Alienware Subsidiary in Trademark Case Concerning ALIENWARE and Vanity Phone Number Marks

Represented Dell and its subsidiary, Alienware, in a case involving infringement of Alienware’s ALIENWARE mark, Alien Head logo, domain name and vanity phone number, as well as false and misleading advertising by headphone retailer Alien Head Gear LLC. In the wake of successful motion practice, judgment was entered against Alien Head Gear and its owner. The defendants were ordered to cease use of their marks and advertising, pay Dell $275,000, transfer their website to Dell, and turn over all remaining stock of their product to Dell for destruction.
