Representation of Pom Wonderful in connection with a trademark case in the U.S. District Court for the Central District of California. The case sought relief against Pur Beverages over the sale of “pur pom” energy drinks, which violate Pom Wonderful’s trademark of its “POM” line of juices. The court upheld Pom Wonderful’s infringement claims on summary judgement, and also rejected Pur Beverages’ defense that the word “pom” was generic or that Pom Wonderful’s use of a heart-shaped “o" in POM constituted abandonment of the registered mark for POM in block letters.
