Represented prepaid debit card company after FTC enforcement action alleging that the client's marketing violated Section 5 of the FTC Act. Our work included moving for summary judgment based on analysis of applicable NACHA and credit card association rules against credit card processor without conducting any discovery. The motion forced defendant to recognize it lacked any legitimate defense, which resulted in a favorable settlement with modest legal fees.
