Overview

Caroline Hudson focuses her practice on marketing, promotions, and privacy matters, and advises clients on the latest developments in intellectual property law, digital advertising, social media platforms, and mobile devices. Caroline also leverages her knowledge of key legal considerations relevant to the food, beverage, and dietary supplements industries to provide guidance on labeling, claim substantiation questions, and other regulatory issues.

Caroline regularly advises brands, advertising agencies, and media and technology companies on sweepstakes, contests, advertising clearance, and claim substantiation, as well as issues involving social media and user-generated content. She has extensive experience negotiating talent, sponsorship, licensing, and media technology agreements. In addition, Caroline represents clients in disputes before the National Advertising Division (NAD), the Online Interest-Based Advertising Accountability Program (OIBAAP), and broadcast television networks.

Drawing on her experience with food, beverages, and dietary supplements, Caroline routinely advises clients in these industries on labeling regulations, claim substantiation, disclosures, and web/social media engagement. Caroline’s review of advertising and labeling materials includes guidance and consultation on regulatory requirements and false advertising class actions brought under various state consumer protection laws.

In addition, Caroline has extensive experience working with clients on managing their complex compliance obligations with respect to privacy and data security, including advising on recent developments, litigation trends, and laws like the California Consumer Privacy Act (CCPA). As part of her privacy practice, Caroline helps clients develop internal and consumer-facing privacy policies, and advises on a wide variety of security, use, and sharing practices with respect to consumer data. Caroline reviews brand websites and mobile apps for privacy law compliance issues and prepares website and mobile app terms of use on behalf of clients. Caroline further assists clients with privacy due diligence matters for corporate mergers and acquisitions.
