BIOGRAPHY

Monique Bhargava counsels brands, advertising agencies, and media and technology companies in all aspects of advertising, marketing, data privacy, new media and intellectual property law. Armed with practical and business-minded solutions, she helps clients across a broad spectrum of industries to achieve their goals while navigating legal risks.

Ms. Bhargava regularly assists agency and brand clients with clearance and claim substantiation. She also has extensive experience negotiating sales and marketing agreements, advertising and media technology agreements, as well as talent, sponsorship and licensing agreements. Ms. Bhargava works with clients to structure compliant consumer incentives and programs, including sweepstakes, gift card incentives, telemarketing, loyalty programs and cause marketing campaigns. She also counsels on the use of new technology and media, such as e-commerce, mobile marketing, social media and user-generated content.

Data privacy and security is another area of concentration for Ms. Bhargava, particularly where these issues intersect with consumer advertising and marketing practices. She works with clients to develop internal and consumer facing privacy policies and practices, including with respect to mobile and cross-device data collection and use, and targeted advertising. She also assists clients in developing and executing data breach response plans, and advises on data security, use, and sharing practices.

In addition, Ms. Bhargava represents clients in false advertising, copyright and trademark litigation and disputes before the National Advertising Division. She also works on matters related to UDRP proceedings, domain name management and enforcement, and gTLD strategies.

Outside of the office, Ms. Bhargava has served as an adjunct professor at the University of Illinois College of Law, where she has taught advertising and promotions law. She is committed to pro bono service and works with Chicago Volunteer Legal Service, the Domestic Violence Legal Clinic and Lawyers for the Creative Arts, among other community organizations.
