Senior Counsel
Ted Duver's practice focuses principally on representing clients in regulatory and complex litigation matters before state and federal regulatory agencies and courts. Mr. Duver has represented public utilities in numerous rate cases and generic rulemakings. He has assisted clients in obtaining regulatory approvals for energy-related transactions. He has litigated matters before the Federal Energy Regulatory Commission including a dispute arising over the development of major transmission infrastructure. He also has represented clients in complex litigation matters including, for example, defending against claims of monopolization and attempted monopolization and representing a market participant in the Enron bankruptcy against allegations of wrongful termination of power supply contracts.

Prior to joining Loeb & Loeb LLP, Mr. Duver was counsel at Day Pitney LLP.

Represented utility companies in regulatory proceedings before the New York State Public Service Commission concerning the unbundling of potentially competitive energy services, metering, billing, and the Home Energy Fair Practices Act

Advised energy service company on the regulatory issues related to its participation in retail access program in New York

Worked with utilities and a major financial institution on regulatory matters before the Federal Energy Regulatory Commission, including seeking approval for the transfer of jurisdictional assets

Served as lead counsel for water company before the New York Court of Appeals on a matter concerning a successful challenge of a municipality's assessment methodology under the real property tax law
