Tal Dickstein

Tal Dickstein maintains a broad-based litigation practice with particular experience in intellectual property matters in the music and advanced media industries. He has represented music rights holders and music licensing organizations in copyright infringement and royalty disputes, defended major media companies in trademark infringement actions, and advised entertainment companies on copyright issues.

Mr. Dickstein also has experience in commercial litigation matters, including contract, real estate and corporate governance disputes, and has handled all phases of discovery and pre-trial litigation in federal and state courts.

Prior Work Experience

Most recently, Mr. Dickstein served as a law clerk for the Honorable Louis L. Stanton of the United States District Court for the Southern District of New York. Prior to his clerkship, Mr. Dickstein was a litigation associate at Jones Day LLP.

Intellectual Property

Successfully defended copyright infringement lawsuit against producers of a song that reached number one on Billboard’s charts and obtained summary judgment on all claims.

Obtained summary judgment for Comcast Corporation rejecting trademark registrant's infringement claims and $70MM reverse confusion claim over name of Comcast's television and movie website.
Successfully advocated on behalf of music rights holders in dispute over exploitation of a popular Broadway musical and negotiated favorable settlement.
Successfully advanced copyright infringement and music royalty claims on behalf of music rights licensing organization, resulting in favorable settlement.
Advised major entertainment company on elements and scope of statutory damages under the Copyright Act.
Helped secure preliminary injunction in false advertising case involving competing claims of superior high-definition television picture quality.
Successfully advanced novel claim under the Cable Communications Policy Act against telephone company based on company’s interference with cable signals.
Obtained preliminary injunction in cyber-squatting action to recover ownership of infringing domain names.

Commercial Litigation

Obtained complete dismissal of multi-million dollar lender liability lawsuit prior to discovery.
Litigated shareholder appraisal suit in Delaware Chancery Court and negotiated favorable settlement.
