The U.S. Court of Appeals for the Seventh Circuit ruled in a lawsuit that WMS Gaming Inc. is entitled, under the Lanham Act, to recover infringing defendant PartyGaming PLC's (a subsidiary of WPC Gaming Productions Ltd.) profits without having to prove what portion came from lawful business and what portion came from infringing uses of the trademark.
