Former Deputy Director of NAD to Co-Chair Loeb & Loeb’s Advertising Disputes Practice

NEW YORK - David Mallen, former Deputy Director of the Better Business Bureau’s National Advertising Division (NAD), who joined Loeb & Loeb LLP last month, and partner Thomas Jirgal have been appointed co-chairs of the firm’s growing Advertising Disputes Practice. The multidisciplinary practice offers sophisticated risk management guidance and litigation services to help clients avoid or overcome competitive or regulatory challenges to marketing and advertising.

“Loeb & Loeb has been a trusted legal advisor in the area of advertising disputes for many years, but with the addition of David and his background inside the NAD, we are even better positioned to assist clients in this important area,” said Kenneth Florin, partner and co-chair of the firm’s Advanced Media and Technology Department. “Combined with Tom’s vast experience defending and challenging advertising claims before the NAD and in court, now more than ever Loeb & Loeb offers a unique and unparalleled leadership perspective in this space.”

“As companies seek to develop innovative strategies to expand their businesses and remain competitive in today’s market, few areas of law are changing more rapidly than advertising and consumer protection,” said Jirgal. “Our Advertising Disputes Practice pulls expertise from a broad range of disciplines within the firm in order to provide clients with the most cutting-edge counsel on matters involving the development, substantiation, approval and defense of advertising and marketing campaigns.”

With a national team comprised of more than 20 experienced attorneys across the firm’s New York, Los Angeles, Chicago and Washington, DC, offices, Loeb & Loeb’s Advertising Disputes Practice represents advertisers of all types who employ both traditional and new media platforms to reach, serve and expand their markets. A natural extension of the firm’s nationally recognized advertising and promotions, consumer protection defense, trademark and general litigation teams, the practice defends clients in significant actions brought by regulatory agencies at the state and federal level, including the Federal Trade Commission, the Federal Communications Commission, the U.S. Department of Justice, and state Attorneys General. The team also regularly handles the defense of class action litigation as it relates to false advertising, and has extensive experience representing advertisers both in court and in proceedings before NAD and the Children’s Advertising Review Unit, advertising industry self-regulatory programs administered by the Council of Better Business Bureaus.

“Loeb & Loeb has built an impressive practice and team that addresses a wide array of issues in the advanced media, advertising and consumer protection fields,” said Mallen. “We are at the forefront of this very dynamic industry, and I look forward to working closely with Tom and other leadership throughout the firm to continue Loeb & Loeb’s innovative approach to these matters.”
