Loeb & Loeb Represents National Pork Producers Council in Trademark Victory for ‘The Other White Meat’

Loeb & Loeb LLP played an important role in a recent precedent-setting trademark victory on behalf of the National Pork Producers Council, when the Trademark Trial and Appeal Board ruled that the mark ‘The Other Red Meat’ for salmon would be likely to dilute the mark ‘The Other White Meat’ for promoting the interests of the pork industry.

The National Pork Producers Council and the National Pork Board opposed Supreme Lobster and Seafood Company’s registration of the mark ‘The Other Red Meat,’ asserting that registration of the mark would result in dilution of the similar and well-known pork mark, blurring its distinctiveness under Section 43 (c) of the Lanham Act.

Based upon extensive evidence, including results of a telephone survey demonstrating close association between the marks, the Board sustained opposition.
