U.S. companies with employees, customers, affiliates, data processors, and suppliers in the European Union should be familiar with European privacy laws, which in general are broader and more stringent than U.S. privacy laws. This seminar will cover:
- The jurisdictional scope of the E.U. Data Protection Directive as it applies to U.S. companies, and the use of technology and equipment based in the E.U. to process data (e.g., servers, cookies, IP addresses, web bugs);
- Recent examples of enforcement actions against U.S. companies and an outline of the penalties that can be imposed;
- A discussion of risks associated with global Human Resources databases and cross-border data transfers; and
- Strategic options for U.S. companies for complying with European privacy laws (e.g., Binding Corporate Rules, Safe Harbor, Model Contract Clauses)
