This article addresses the potential legal issues faced by aging Americans who, more and more, are suffering from psychological disorders that can affect their ability to make decisions concerning their care and estate. With estate disputes on the rise, questions about capacity and undue influence are increasingly common. Knowledge of the methods used to evaluate capacity, the disorders that affect it and the legal options available is essential for all parties involved with the care of the elderly.
