Mark Douglas maintains a diverse litigation practice focusing on complex commercial cases involving bankruptcy and creditors' rights, securities litigation and regulatory investigations. He represents a wide variety of stakeholders in chapter 11 proceedings, handling claims administration, negotiations with creditors, and asset recovery. He also regularly represents corporate and individual clients in high-profile investigations related to securities and accounting fraud and other alleged misconduct.

Additionally, Mr. Douglas handles a wide array of general business disputes, breach of contract claims, commercial real estate disputes, trust and estate litigation and will contests. His clients include domestic and foreign corporations from a variety of industries, as well as senior executives, committees, trustees and high net worth individuals.

Mr. Douglas is also involved with a number of pro bono and mentorship initiatives. As a regular volunteer with the New York Urban Debate League, he spearheads Loeb & Loeb’s work with the Justice Resource Center’s MENTOR program, serving as a coach to high school students in connection with moot court and mock trial competitions. He also contributes to the firm’s Veterans Assistance Project, providing pro bono legal counsel to U.S. military veterans who are seeking disability benefits from the Department of Veterans Affairs.

Representative Experience

  • Secured a $14 million summary judgment award for U.S. manufacturer in breach of contract action against the Republic of Iraq. Servaas, Inv. v. Republic of Iraq, 2012 WL 335654 (S.D.N.Y. Feb 01, 2012) (09 CIV 1862 RMB).
  • Achieved dismissal in favor of defendant client for lack of personal jurisdiction. The published decision is The Bank of New York Mellon v. SACE S.p.A., 2011 WL 102728 (S.D.N.Y. Jan 06, 2011) (NO. 10 CIV 2510 RMB); 2011 U.S. Dist. LEXIS 2386.
