Practice Capabilities

The trial lawyers who make up Loeb & Loeb’s Litigation Group are experienced in defending and prosecuting significant, high-stakes cases in jurisdictions across the country. We have represented clients before judges and juries at every level of the federal and state court systems, as well as in mediation, arbitration and regulatory agency proceedings. Our litigation strength, imagination and cross-practice collaboration are key factors behind our clients’ success in these matters. Our clients, ranging from Fortune 500 companies to individuals, trust us to deliver high-quality litigation counsel with a consistent focus on their business objectives and a steady determination to add value to each and every matter.

In addition to representing our clients in complex commercial contract disputes, our Litigation Group’s significant experience extends to the following disciplines:

  • Securities
We litigate securities class actions and derivative actions throughout the country, from pleadings through trials and appeals. We also defend our clients against regulatory investigations, enforcement proceedings and arbitrations.
  • White Collar Criminal Defense, Corporate Compliance and Investigations
We help our clients navigate the difficult legal and business issues that arise when companies or individuals are investigated or charged by law enforcement or regulatory agencies. We also engage proactively to help our corporate clients ensure internal compliance with the law and best business practices.
  • Professional Services
We have defended literally hundreds of significant professional liability claims and have represented professional service firms in virtually every kind of dispute and investigation.
  • Intellectual Property and Entertainment
We combine our unmatched industry knowledge with legal expertise in antitrust cases, particularly cutting-edge issues involving licensing of IP rights; copyright and trademark law; rights of privacy and publicity; and unfair competition.
  • Patent
Our significant litigation and trial experience encompasses patent cases involving all types of technology, including computer software, semiconductors, pharmaceuticals, medical devices, military technology, consumer products, mechanical devices, electronics and optics.
  • Employment Litigation
We defend our clients before state and federal courts, as well as various administrative bodies including the EEOC, in employment matters that allege discrimination, harassment and wrongful termination; violation of restrictive covenants; unfair competition, corporate raiding and trade secret misappropriation; class action wage and hour violations; disability access and accommodation issues; ERISA compliance; and bonus compensation and contract disputes.
  • Consumer Protection and Unfair Competition
We defend clients who find themselves the subject of government enforcement actions or the target of investigations that allege violation of consumer protection laws. We also defend private class action lawsuits that allege violation of consumer protection and unfair competition laws and represent businesses in inter-company disputes involving unfair business practices and false advertising claims.
  • Marketing Advertising and Regulatory
We defend clients who are accused in significant advertising-related actions brought by regulatory agencies at the state and federal level. We also prosecute and defend claims of consumer fraud, misleading advertising, and deceptive or unfair trade practices.
  • Trusts and Estates
Our national reputation in this highly specialized field is the result of many successful appeals to the United States Supreme Court, the California Supreme Court, and various state Courts of Appeal. Whether at trial or through settlement, we help realize the best results for our corporate fiduciary, charitable beneficiary, and individual fiduciary and beneficiary clients.
  • Bankruptcy, Restructuring and Creditors’ Rights
We represent creditors, debtors, financial institutions, committees, trustees and buyers and sellers of assets. We also represent investors in creditors' rights, bankruptcy and insolvency-related litigation, including pursuing and defending collection and recovery motions, and establishing and enforcing receiverships.
  • Information Management and Electronic Discovery
In addition to counseling clients in litigation proceedings involving the gathering, review and production of records, including electronically stored information (ESI), we help companies develop data retention policies, conduct pre-litigation assessments, and mitigate the risks and costs associated with eDiscovery.

Service Approach

The Loeb & Loeb Litigation Group service approach is founded on three core principles.

Achieving client objectives
We understand that every litigation matter is first and foremost a business matter – one that comes with its unique set of risks and rewards that must be identified and assessed in the context of the client’s priorities before determining the appropriate course of action. From our first client meeting through a litigation matter’s final resolution, every step we take is directed to better achieving the client’s specific business objectives.

Trial Perspective
Once litigation has begun, we prepare every case as if trial is inevitable. This trial preparation perspective allows us to focus on what is most important in the case: the core facts, the witnesses and documents necessary to put those facts into evidence and the law on which the case will be decided. We do not become distracted from the preparation of the case for trial because we believe that this is the best way to drive a favorable settlement or summary disposition - or else be ready to present the most formidable case in the courtroom.

Responsiveness
Every client, and every matter, is a priority to us. We know that we need to be available to our clients and we are.
