Loeb & Loeb represents the State of Delaware in its unclaimed property examination of Plains All-American Pipeline, LP in a dispute as to whether Delaware has the legal right to examine Plains’ books and records to identify unclaimed property. Plains filed suit, asserting that Delaware’s right to audit its unclaimed property was violative of a number of statutory and constitutional provisions. Loeb successfully filed a motion to dismiss, asserting that Plains’ suit was premature, and that the proper venue for review of Delaware’s right to audit Plains lies in the Delaware Court of Chancery. The case is currently on appeal to the United States Court of Appeals for the Third Circuit.
