Obtained Summary Judgment for Production Company for Breach of Contract Case

Obtained summary judgment for production company MAF Productions, Inc. in case involving a promotional video starring William Shatner. Plaintiff Tattletale alleged that MAF breached the parties’ contract when it demanded that Tattletale comply with the contractual restrictions regarding the scope of use of the Shatner promotional video. The Court rejected Plaintiff’s claims, holding that “[b]y Tattletale's own account, MAF's only wrongdoing was demanding that Tattletale stop using the Sales Video in a way that MAF thought violated the Agreement. A party to a contract demanding that another party perform its obligations is a legitimate (and expected) activity if the party believes the other is not performing. Plaintiff has presented no authority or reason for the Court to find Tattletale's theory a cognizable claim under contract law.”
