We have worked on virtually every type of transactional and operational challenge the industry has faced in the last 35 years and have developed a broad network of contacts throughout the public and private sectors. Our attorneys know their way around federal and state agencies and regulatory commissions, including the North American Electric Reliability Corporation (NERC), the Federal Energy Regulatory Commission (FERC), the Department of Energy (DOE) and the Nuclear Regulatory Commission (NRC). In addition, we are known and respected by the private regional transmission organizations (RTOs) and the independent system operators (ISOs) across the country.

From identifying available tax credits for maximum financial benefit, to acquiring, developing and implementing Smart Grid technology, we have helped clients tackle major development and infrastructure projects across the US. Our representation of clients working on developments in green technology spans renewables from wind, solar, hydro and waste-to-energy to innovative geothermal innovations. In the traditional electric, natural gas and nuclear fields, we have advised on numerous projects for utilities, governments and public-private partnerships that have paved the way for transmission grid expansion, power generation advancements and facility upgrades.

Service Approach

Our attorneys are known for helping clients develop innovative and cost-effective solutions that encompass a broad range of transactional, litigation and regulatory challenges.

We have developed creative solutions that have allowed independent generators of renewable energy to connect to the transmission grid while minimizing the impact of regulation. We have also helped craft tax-advantaged corporate structures and state-of-the-art debt financings, including one of the first ownership partnerships that encompassed public-private entities. In response to the recent turmoil in the auction-rate securities markets, we have developed several new products and solutions that address our clients’ short- and long-term financing needs.

True to Loeb & Loeb’s commitment of adding value to every client’s matters, the Energy Group works closely with colleagues throughout the firm to deliver comprehensive representation through cross-firm, cross-practice collaboration and teamwork.

We work in tandem with litigators and attorneys from every discipline and office location. Our Washington, DC, office is positioned to provide robust regulatory, legislative and public affairs services for clients and allows our attorneys to maintain close contact with colleagues across myriad energy-focused federal agencies and commissions.

On the West Coast, our presence allows us to efficiently handle the surge in investment opportunities originating from the many green energy companies headquartered in that region. In addition, we provide counsel in response to interconnection issues and new state and federal regulations that are the lasting legacy of California’s energy crisis of 2000.

The firm's office in Beijing, China, coupled with our long history of working with Chinese companies in the US and within the PRC, supplements the depth of service offered by our energy practice. We offer a deep knowledge of the renewables industry – a major focus of state-owned companies in China today. We also offer a thorough understanding of inbound and outbound transactions that are essential in developing successful global partnerships and traditional energy ventures. Our Beijing office also allows us to bridge cultural, time zone and language barriers for Chinese, US and multinational clients pursuing energy-related opportunities throughout Asia.

Loeb & Loeb energy clients receive the attention and knowledge of senior-level attorneys. This experience means that our attorneys are engaged, up-to-speed and focused on the issues at hand, be it a complicated utility rate case or a complex merger with antitrust implications. This efficiency fosters a productive relationship between our attorneys and our clients and enhances the value we provide.

Leadership in Law

Our Energy Group attorneys bring a combination of experience that includes positions inside the industry, work at various government agencies and commissions, and involvement with some of the most pressing energy issues in recent history.

Members of our group have taken leadership roles throughout their legal careers. These include serving as senior counsel to the Senate Committee on Homeland Security and Governmental Affairs for the Special Investigation of Hurricane Katrina; advising the US Agency for International Development on eastern European energy reform; serving as Chair of the New York State Bar Association Business Law Section; and participating in FERC’s RTO, transmission pricing and other competitive market initiatives.

We also draw upon the experience of other Loeb & Loeb attorneys, such as our colleague, former California Governor Gray Davis, who offers clients an unparalleled understanding of the western energy markets in California and surrounding states.
