Creating an Artificial Intelligence Use Policy for Your Company and the Legal Ethics of Using Artificial Intelligence

Loeb’s Brian Heidelberger, chair of the firm’s Advertising, Marketing & Promotions department; Advanced Marketing & Technology partner Liz Allen; Litigation partner Michael Zweig; Chief Information Officer David Lampert; and Advanced Media & Technology associate Shely Berry discuss the importance of an internal artificial intelligence (AI) use policy and provide effective strategies for lawyers, employees, and vendors to stay compliant.

When used in compliance with business practices, AI can be a lucrative tool to optimize performance. However, as witnessed in recent cases involving the improper use of Chat GPT and other AI tools, it is apparent that artificial intelligence is an evolving issue that requires a proactive approach to gain a comprehensive understanding of the regulations and the internal education needed to mitigate damages.

When developing effective AI use policies, law firms and businesses should consider additional training such as ISO 27001 Privacy Information Management System (PIMS) in addition to ISO 27001 SMS certifications. For law firms, it goes back to the basics of ensuring you are in compliance with the ABA Model Rules of Professional Conduct.
