Edward Russell’s practice focuses primarily on title insurance and real estate litigation, as well as the representation of creditors in bankruptcy in connection with enforcement of their rights and their protection from debtor fraud.
Mr. Russell has both prosecuted and defended disputes in federal and state courts regarding real property disputes, protecting the contractual rights of secured creditors in bankruptcy courts, and institutional lenders from claims of wrongful foreclosure.
In title insurance matters, Mr. Russell litigates title and accompanying real estate issues on behalf clients such as Fidelity National Title, Chicago Title, and Ticor Title, who each insure institutional lenders and property owners.
Mr. Russell has conducted lengthy jury and non-jury cases, having served as lead counsel in those matters. He has also successfully represented his clients on appeal following trial, obtaining affirmances on matters involving easements, non-judicial foreclosure, mortgages, and the validity of state statutes.

Prior to joining Loeb & Loeb LLP, Mr. Russell was Vice President of Fidelity National Title Company.
Representative Experience

Successfully argued before the bankruptcy judges of the Northern and Eastern Districts of California on behalf of Sears Roebuck & Co. against Sears being sanctioned for seeking the reaffirmation of the secured debt owed to it by debtors; the judges being convinced that Sears could properly seek such reaffirmations under the Bankruptcy Code, and that, Sears did not improperly assess attorneys’ fees to those reaffirmations.

Successfully defended Chicago Title Company in a dispute involving the timing of a non-judicial foreclosure in which Chicago Title was the trustee. The trial court dismissed Chicago Title through a motion for summary judgment, saving Chicago Title some $2 million in potential damages.

Successfully defended the secured interest of World Savings & Loan Association after a lengthy trial in litigation involving real property in Malibu, California, valued in excess of $3 million.

As lead counsel, defended Fidelity National Foreclosure Solutions in a two-month jury trial in which a junior lien holder asserted wrongful foreclosure, successfully keeping the matter from becoming a class action, avoiding the exemplary damages phase of the trial.
