Edward H. Rice

Edward Rice focuses his practice on patent litigation trials and appeals. He has first-chaired and won trials in every major patent litigation forum in the United States, including US District Courts, the International Trade Commission (ITC) and the Court of Federal Claims. He also is an accomplished appellate lawyer who has argued and won an en banc decision in the US Court of Appeals for the Federal Circuit.

Mr. Rice has successfully represented both defendants and plaintiffs in a wide variety of patent infringement cases. His trial experience includes bench and jury trials in federal district court as well as bench trials before the ITC. Over his career, Mr. Rice has litigated a broad spectrum of patented technologies ranging from computer/electrical products (computer memory chips, display controller chips, semiconductor photolithography, electrical switches, computer navigation systems, laser devices) to life science products (anti-viral compounds, biological sterilization processes, dental instruments, pharmaceuticals) to mechanical/structural products (hydraulic door closers, flange connectors in building construction, industrial plastic wrap, bomb-proof shelters), to Internet business methods (Internet loan marketplace, credit card verification systems).

Mr. Rice's pharmaceutical patent experience includes Paragraph IV litigation under the Hatch-Waxman Act and working with pharmaceutical clients on developing legal strategies for their products.

In addition to his patent cases, Mr. Rice has litigated trademark, copyright and trade secret cases, as well as other matters involving intellectual property issues.

Mr. Rice also has volunteered with the Midwest Immigrant & Human Rights Center and has provided pro bono representation for individuals seeking asylum in the United States.

Prior Work Experience

Prior to joining Loeb, Mr. Rice was a partner at Sonnenschein Nath & Rosenthal LLP. He began practicing intellectual property litigation in 1988 at Keck, Mahin and Cate in Chicago. He left Keck to clerk for the Honorable Charles R. Norgle, Sr., in the US District Court for the Northern District of Illinois. After his clerkship, Mr. Rice joined the Department of Justice (DOJ) in Washington, DC, where his practice focused on patent litigation. He tried patent lawsuits filed against the Government in the Court of Federal Claims and held a secret security clearance. Among his other accomplishments at DOJ, Mr. Rice successfully defended the United States in a two-week patent infringement trial involving the Navy's computerized command and control systems, including the AEGIS System and the Naval Tactical Data System (NTDS). Mr. Rice also developed his appellate skills at DOJ, where he was involved in many federal circuit appeals including an en banc appeal that he argued and won. During his DOJ service, Mr. Rice received three Department of Justice Special Achievement Awards.
