Don Miller's practice focuses on litigation, especially matters involving entertainment issues. Mr. Miller has successfully litigated a wide range of IP and entertainment issues on behalf of prominent clients in the motion picture, television, music, and book publishing industries, including, for example, accounting, distribution and contract disputes; copyright and credit disputes; anti-piracy issues; and trademark, false advertising, and unfair competition claims.

Mr. Miller has also handled disputes involving complex accounting and business issues, legal malpractice, insurance coverage, and section 1983 civil rights litigation.

Prior Work Experience

Prior to law school, Mr. Miller worked for the Cleveland office of Ernst & Young as a CPA (licensed in Ohio). In addition, Mr. Miller was elected and served as a councilman for his hometown, Sheffield, Ohio.

Before joining Loeb & Loeb LLP, Mr. Miller worked as an associate for the entertainment litigation boutique firm White O'Connor Curry LLP.

Representative Experience

  • Represented the author of a New York Times best-selling novel against book publishers in a dispute involving the allocation of net profits from the distribution of the book.
  • Represented the world’s four largest record companies against a website, prosecuting the companies’ claims of copyright infringement and defending against the website’s claim of an affirmative defense under the DMCA.
  • Obtained money judgment in Lanham Act false advertising trial on behalf of a popular juice product.
  • Successfully defended the author of a New York Times best-selling novel against claims of co-authorship in the novel and co-ownership of the copyright in the novel.
  • Represented a major book publisher in a dispute with a major studio involving the accounting for and distribution of the highest-grossing movie franchise of all time.
  • Obtained summary judgment on behalf of a major music label in copyright infringement action in connection with the illegal distribution of karaoke products.
  • Represented a national television network in an accounting and breach of contract case involving a successful TV series against one of Hollywood's most prolific television series distributors.
  • Represented a major studio and a national television network in a multi-week trial disputing the allocation of the billions of dollars generated by one of the most successful situation comedies in the history of TV syndication.
