Overview

Vadim Rubinstein leads a bankruptcy practice with a broad range of experience in both the transactional and litigation aspects of bankruptcy cases and out-of-court workouts. He has advised clients in the insolvency and bankruptcy context across a wide range of industries, including real estate, entertainment, energy, aviation, manufacturing, technology, retail, telecommunications, pharmaceuticals and trucking.

Vadim regularly represents DIP lenders, secured lenders, trade creditors, landlords, investors, strategic purchasers, title companies and trustees in complex business reorganizations, Subchapter V restructurings, out-of-court workouts, financial transactions and litigation.

Finding a creative solution requires an ability to dismantle the data and perform an in-depth analysis. You can’t solve a problem without turning over every stone and reviewing every page.

Vadim frequently represents indenture trustees and administrative agents in numerous significant bankruptcy cases throughout the country, including the bankruptcy cases of Hertz Corporation, Chesapeake Energy, GT Advanced Technologies, Armstrong Energy, Ion Media, Residential Capital and Washington Mutual, among others. 

He has developed particular expertise in the recently enacted Small Business Administration Act, advising clients on all aspects of Subchapter V bankruptcies in numerous industries, including movie theatres, wine, retail and real estate.  

As a member of the firm’s Real Estate Finance Group, Vadim regularly issues legal opinions related to commercial lending transactions, including non-consolidation, true sale, safe harbors and authority to file opinions.
